Casinos & Racetracks: Gambling at casinos and racetracks is completely legal. Winnings from casinos and racetracks are eligible for gambling tax refunds provided you file within the required three years.

Prizes: If you win any prizes, such as a car or a trip, you can also be taxed on them. Entering draws is legal, but the IRS will still tax you on your prizes.

Video Lottery Terminals: If you win anything on video lottery terminals, this also counts as gambling winnings. We recommend sticking to the terminals in casinos. You may be tempted to get in a few games if you’re at a restaurant or gas station and there’s a video lottery terminal, but we suggest sticking to casinos for gambling of this type. It’s just safer in terms of avoiding any type of fraud or even identity theft.
